Liability Release Form
Please read our Terms & Conditions before signing this form. Then read and sign this Tahoe Mountain School (TMS) Form. This Release Form must be signed and then emailed, faxed or mailed before your Registration Form can be processed.
Release and Assumption of Risks: I am aware that during the climbing/mountaineering courses that I am participating in under the arrangement of Tahoe Mountain School, certain risks and dangers exist including, but not limited to, travel by air, automobile or other conveyance, travel in mountainous terrain, the forces of nature, accident, injury, illness, paralysis or death in remote places without rapid means of evacuation or medical facilities.
In consideration of, and as part payment for, the right to participate in such course, and services arranged for me by Tahoe Mountain School, its instructors, guides, agents and associates, I have and do hereby assume all of the above risks and will hold them harmless from any and all responsibility, negligence, actions or suits of any kind or nature whatsoever for loss or damage to property or personal injuries sustained or occurring during any course, guided trip, or activity of any nature. This shall serve as release and assumption or risk for myself, my heirs, administrators, executors, and for all members of my family including minors who may be accompanying me. I agree that if I sue or make any claims against Tahoe Mountain School, in violation of this waiver, I shall be liable to Tahoe Mountain School for all costs and attorneys' fees incurred by Tahoe Mountain School in defending itself from such action or claim.
Cancellation and Refund Policy: If you have to cancel for any reason (including medical), we require written notice in our office 14 days in advance of the first day of the course. With 14 days or more notice we can refund your payment minus 10% for administrative costs. Once we are within 14 days of the first day of the trip, we unfortunately cannot refund any portion of your payment even in the event of sudden illness or injury to you or your family. We recommend that you buy trip cancellation insurance (available through your travel or insurance agency) in case you get sick or injured (please stay healthy!!) before or during the trip. If TMS must cancel a course or trip due to inadequate registration, extreme weather circumstances, etc. you will receive a full refund or can be registered in another TMS course. However, TMS is not responsible for additional expenses incurred including non-refundable airline tickets, equipment, medical expenses, etc.
I have read and do agree to the "Cancellation and Refund Policy" and all conditions under "Terms & Conditions" as stated in the Tahoe Mountain School "Terms & Conditions.” I understand and agree that my contract with Tahoe Mountain School is entered into in Truckee, California, upon my being placed on the course or trip roster. This waiver shall be interpreted in accordance with the laws of the State of California.
